Im due to sign my daughter up for secondary in september , i have all the proof i.e rental agreement and utility bills which i could provide as proof but the issue i have is im on no council tax bill anywhere 😰 i was and then i left stayed with my dad , now my kids stay here all the time as they have own rooms an i come of-a morning take them to school etc but just until I can find somewhere else which will most likely be after xmas... i have approached the council and as i stay between this house and my dads i dont need to go on council tax . Any advice appreciated asi want to secure my daughter a place being honest with my tricky situation

I can't see that that's going to be right for Council tax. It'll be your primary residence, so where you pay rent and utility bills I'd expect. I would be careful on that as they will pursue it.
Otherwise it would be far too easy for someone to say "oh this is my house, but I stay with my friend half the week, so I don't have to pay"-and the friend does the same back, so neither pays.

If you use your dad's address then it may look like you are trying to fool the system, as that would be an unusual arrangement. Is it a better school near your dad's?

Council tax isn't a personal tax though is it, as long as full tax is being paid on the properties why does it matter where the OP lives, it would only be an issue if a single person discount was being wrongly claimed surely.

It would be helpful to know where you are OP, I haven't come across a school application that asks for any council tax proof but I know different LAs have different rules.

Basically your DC live with their Dad! And from there it is quite simple, as they live with their Dad that is their address for school application.
Just because their mother lives somewhere else has no relevance.

And even if your eldest isn't actually his daughter - then she would be seen as living with her Step Dad.

Molly it's not the Dc's dad, it's the Op's dad.
That's why I would think she'll be at risk of them thinking she's gaming the system if the school she would get them in from there is more desirable, as that is the sort of thing people do try.
if it was the dc's dad, I wouldn't think there would be that risk.

No. OP and ex and their kids live in house A where they have all lived together for years. OP and ex have split up but ex hasn't moved out - not sure why not. When things get tense OP goes to her fathers leaving the kids where they are. The ex is the de facto parent with care.

What address have you used to make the application? The correct one is your ex’s house where the children actually live (and which you’ll presumably move back to?)
I don’t get the issue. If your ex is paying council tax as he should then he can provide admissions with a copy of the bill relating to the house your child lives in?

So the children stay with their dad, so dad applies, you not paying council tax won’t come into it (I am assuming dad is getting the child benefit?)
