6th form place refused due low attendance due to Stress

Sorry about the long title. My sd is currently in year 11all boy's school which does not have a 6th form. This is based at the girls school and we have applied there for 6th form. Since starting year 11 he has had a lot of sickness mainly stomach and stress related issues due to internet bulling. His attendance is around 83% but if take in to account all the days he's visited the gp and hospital (4ae visits one minor operation). It goes up to 97% he's seeing the school counsellor and the doctor has written to the school confirming he is suffering from anxiety and stress. Any we should have heard from the 6th form by end in feb ....nothing. Now to make matters worse last week DS was told by another boy that out of all the boys who applied only 3 were rejected and he was one if them. Ie the teacher has given out names. Today I will be investigating this with the school to find out if this is true and if it is then I will be putting in a formal complaint. I'm also going to ask for copies under the data protection act of correspondence between the two partner schools regarding my son. Basically I need to know of the 6th form were aware of his mental health issues or not. If they are and he has been refused a place because if this then this is a discrimination case and to me very serious matter. Or is it because his current year have not explained the matter correctly and then again I need to peruse but with then not the 6th form. Either way I have done some internet searches and I seem to be getting informed that refusing a place a 6th form can not be based in attendance Anyone know of that is true or please any advice. Last week he was so stressed at school he was sick all over him self. He nearly 16 and the enjoyed every minute of years 7-10. And now this happens

Thanks for you comments it's very helpful. What I have done is spoken to a senior teacher and raised my concerns but done it on a 'this the rumour going round the school'. As to be honest I would be extremely shocked if his name had been mentioned. I have also asked the school of copies of what has been sent to the 6th form as whilst his mocks were shocking ( at the hight of his absence ) he is still predicted mainly c and a couple of B Plus the school is offering retakes for English and maths and lots of Btec options. ( we are in a grammar school borough and this is not a grammar school).

The bottom line here is that you need a written statement of whether your son is being offered a place in the 6th form or not. That will always depend on the attainment level that the 6th form require but as Tiggytape says they cannot refuse entry on the basis of poor attendance. That is stated in paragraph 1.9G of the school admission code 2012, which is the relevant document for entry in September 2015.
