Situation - male and female couple moved into flat several months ago. Flat directly across from other properties.
Both completely nude/having sex right in front of bedroom window (curtains/blind fully open).
Latest - female standing at bedroom window fully naked.
There are children in opposing properties.
Law/legalities on this please.

In Scotland, nudity isn't automatically illegal. If someone is sun bathing in the garden naked you wouldnt expect them to just be arrested, the situation you're describing could be legal but potentially cross some legal boundaries.

  • Public Indecency: Under Scots common law, “indecent conduct” in a public place eg. visible sexual activity or exposing genitals, can constitute public indecency. This applies even if the act occurs inside a private residence but is clearly visible to the public.
  • Breach of the Peace: If behaviour causes alarm or serious disturbance to members of the public, it may be prosecuted as a breach of the peace.
  • Sexual Offences Act 2003: It is a criminal offence to intentionally expose genitals with the intent to cause alarm or distress.
  • Children’s Welfare: Given that children are present in nearby properties, the situation could be viewed more seriously, if likely to cause harm or distress to minors.

If its not a one off and happening regularly then keep a diary and report to police if its causing you alarm or distress, particularly with children present. Police Scotland will assess whether the behavior constitutes public indecency or breach of the peace. Have you reported it previously?

Try a note first tell them. Unless they are doing it deliberately they might be mortified and stop and shut the curtains ?

Pretty sure they are well aware, and also, that it is deliberate.
