Dc now works in England but he didnt change his tax code and he thinks hes paid Scottish tax code, which is higher. He thinks hes due a refund.
Has anyone got experience of this?

Isn't it based on where you live not where you work ?

Badbudgeter · 21/03/2023 20:47

Ex works in England but pays Scottish tax as his residential address is in Scotland. What address did he give his work when he joined? If it’s Scottish then he should update his address with his employer.

Invisimamma · 21/03/2023 20:48

Scottish tax codes start with an S so this will be easy enough for him to work out.

berksandbeyond · 21/03/2023 20:49

You pay tax where you live, not where you work. So yep if you live in Scotland you need to pay the higher taxes

spidereggs · 21/03/2023 20:49

Yes, as previous posters, we are close to borders, it crosses our rented farm in places, which is a tax headache. But you pay for your residence address

ssd · 21/03/2023 21:03

He gave his Scottish address as he was still trying to get accommodation sorted

So would updating his address with his employer be enough to get his tax code updated and a refund eventually?

He needs to have lived in England for the majority of the tax year. When we moved from Scotland to England DH had to pay Scottish rate tax for the entire year as we moved in November.

From HMRC:

If you move to or from Scotland

You pay Scottish Income Tax if you move to Scotland and live there for a longer period than anywhere else in the UK during a tax year (6 April to 5 April the following year).
You must tell HMRC of your new address if you move to or from Scotland. You may pay tax at the wrong rate if you do not.

He moved in September last yr so most time spent working in England for this tax year.
How would he go about trying to reclaim it?

He needs to update his address with HMRC giving the exact date of his move, he should be able to do this through his employer. I don’t know how quickly he will get his rebate, but as we’re at the end of the tax year hopefully it will be reasonably soon.

Whether he will have overpaid or not will depend on how much he is earning - he could potentially have underpaid (but only to the maximum of £21)

Has he updated his address with his employer? HMRC can sometimes be quite helpful when you phone them so it might be an idea for him to give them a call and have to hand all his dates of when he moved etc.

Christmascracker0 · 21/03/2023 21:31

If he is resident in England for more than 183 days then he should pay tax at rest of UK rates. You can update your address online but HMRC will need the date he moved to England so might be best to call them.

HMRC are pretty reasonable. Even if in Scotland for the vast bulk of the year he can likely avoid Scottish tax if he can
make the case for having his main ‘home’ by possessions, local club memberships, voting, etc elsewhere.

Call them and have the supporting facts to hand and a well rehearsed discussion about it. If you make your case clearly and with verifiable evidence to support it they are very rarely difficult (if they are just do a
self assessment as if it’s not outrageous it will be computer processed).

A well written letter setting out the amounts due and reasoning/evidence tends to work well but takes forever to be processed.

Thanks for all advice I'll pass it on

I worked in England for 6 months but my permanent address was in scotland so I paid Scottish tax

ssd · 22/03/2023 10:19

If he updates his address with his employer, surely it would be from now rather than from when he moved last year?

OP posts:
Invisimamma · 22/03/2023 20:57

Yeah he's going to need proof for HMRC that his main residence was in England for the majority of the year. Simply changing his address now with his employer won't cut it.

ssd · 22/03/2023 22:53

Thanks
