Scottish tenant rights question

newtoedinburgh · 26/07/2021 09:29

Am I right in thinking that there is no minimum rental period in Scotland now? So - as tenants we can sign a lease and then break it with one month notice when we need to?
Can anyone point me to the legal advice on this?
THANK YOU x

www.gov.scot/policies/private-renting/private-tenancy-reform/

"he new legal requirements for landlords and tenants are detailed in the Private Housing (Tenancies) (Scotland) Act 2016.

The new tenancy, which must be used for all new tenancies created on or after 1 December 2017:

is open-ended, which means a landlord will no longer be able to ask a tenant to leave simply because the fixed term has ended"

see ss 48-49 of that Act.

The level of knowledge among landlords... varies. If there's something else in your contract or your contract is based on English short assured tenancy, but you're in Scotland and you moved in from December 2017, this applies anyway. You can write almost anything into a contract, but not all of it's enforceable.

Yes, 28 days notice is what you need to give.

Yes unless it is private student halls which lock you in for the academic year up to 51 weeks max.
