Where does it say in the legislation that both parents have to be keyworkers?

This page suggests your local community can change rules for its people, so I would suggest looking for advice from your local authority?

I wasn’t asked by the school if both parents were key workers. Only I am a key worker.

Most schools will have limits on places so will fill up with kids with two key worker parents first. If your school has set this as a criteria, then email and ask if you can be placed on a list for a space once all spaces for two key worker parents have been filled. Otherwise, you may need to apply for childcare furlough.

Our local authority said both need to be key workers outside the home, but they are allocating spaces to families with one key worker. If you feel you need a space then apply (ignore the judgey jealous people, who should remember that everyone's circumstances are different). They can only say no

I agree @Throwntothewolves. Ignore any judgment, I am a category 1 worker- NHS but work from home. I have requested and been offered a place. My son finds school work difficult and I simply can’t take time out of my working day to help him.
My husband is self employed and needs to keep business afloat. He will be inundated with requests for furlough from his staff, so time out for him is not an option.
We have taken nothing from the government through this pandemic so I won’t feel guilty about doing this.

That's good @Jodhpurs46! I got refused but told I could use a childminder, out of school care or family members. I'm going to ask again in February if the closure is extended.

Today we received an email asking that key workers reconsider their request. Apparently they have received a much higher volume of requests this time round, so I am expecting a knock back later in the week.
The education offering was so poor last time (40+ tasks dumped in Google classroom every two week, with no teacher interaction and no marking) and I just don’t have time to do my job and work my way through all of that.

I don't blame you for looking for a space but I do think you're possibly being a bit optimistic about the support that will be given in a hub in terms of ensuring pupils do work/understand what they are doing. If the lessons are all online then it could be a single teacher supervising 20 kids from P1-P7, each working online separately, with limited scope to actually "teach" in any shape. Presumably the main class teachers will be uploading lessons/doing some stuff live(?)/answering questions.

We were sent an application form with the criteria outlined. Each local authority is different. Unfortunately as I work from home I wasn't eligible. Dh is keyworker outside the home.

My friend in neighbouring authority got a place at private nursery for her 2 year old despite only her partner being a key worker and her working from home (non key worker role).

From Government site just now. It says only one needs to be a critical worker for children to be able to attend school.

The official scotgov criteria aren't 2 parents but it seems to be the interpretation of most councils

I think councils are open to interpret it any way they like. The problem with Edinburgh council (both parents have to be Key Workers, both working out of the home) is that they banned virtual lessons last time so we just got dire worksheets that required a parent to supervise at all times. Utterly useless if you are trying to work, hence lots of desperate parents trying anything to get places in key workers hubs.

If the council actually provided a basic online education the number of parents requesting key worker hubs would fall. Does anyone have any idea if Edinburgh are planning an improved provision this time around? I am beginning to think that it is a big plot to force parents into private schools thus reducing school rolls.

@Elvesaremagic our school have promised more videos this time (there was one video March to June!) but they will be on demand not live.
I hadn’t realised this was council mandate. Sigh.
