Scottish NHS and 'out of area' assessment refusal

I have asked for an out of area assessment for our child.
Detailing reasons might out me, but we have VERY good (and prove-able) reasons for doing so.

Our GP is not actually saying: 'no' but says: 'it is super difficult, takes many months, must go before panels, and you have to justify it'

We have written to GP stating our wish but had no reply and on subsequent phone call GP 'hoped we had changed our minds'. Suggests that 'we just see a new person here' (not okay as it was the 'top' person there was a problem with, iywim)

What rights do we have, does anyone know?

My medical condition was always out of area iyswim when i became an adult i requested i stay in the city hospital i had attended as a 16yr old. keep at it say you want to proceed at least an initial referal (sp) my orthapedic Dr is at the golden jubilee in clydebank im not sure of your legal positition though what other people i know have done is organised a private consultation and got on the nhs list after than it is queue jumping though a lot of nhs consultants do private consultations (or they used to)
