Appealing CMA

My ex gets £46k pa police pension, pays £200 pm tax, no NI so has net pay of £3800 and the CMA has calculated he pay £99 per week for our 3 kids, whom he doesn’t take overnight ever.
Has anyone ever successfully appealed the amount?

Based on what you’ve said, the calculator says £164 pw. How old are the kids?

Are those figures right...£46k a year is £3833 gross per month. Tax would be £550 ish on a standard tax code in England

What makes you think the CMA have got it wrong? (bearing in mind the figures you've stated don't add up) Does he have any other children?

Police pensions are taxed differently- he pays £200 pm tax and no NI. I don’t know why this is.
Kids are twins, 12 and 15 yr old.
My question is has anyone ever successfully appealed? I have run the calculator.
He told CMA his income was £27000.

The main issue is whether he’s declaring his income honestly. If you think not, tell DWP this, they should make him prove it.
Secondary to this, if you’re working it out using the DWP calculator- it’s based on Gross income ie before tax.
So if he’s on £46k, he’s either ‘accidentally making a mistake’ on his return, or he’s got other kids you don’t know about!

They consider his earnings from the previous tax year. Is he possibly contributing 60% to his pension?

No he retired 10 yrs ago, he is taking his pension now. Last year it was £45k.

If it was an ill health or injury retirement his pension may well be £27k with the rest made up of non-taxable compensation.

I assume they use taxable income to calculate the amount. Ask them to take into account this non-taxable income as well, if indeed that’s what it is.

I have submitted the whole annual pension statement. I thought CMA looked at total income, not just taxable?

Well judging by the number of posters on MN with self employed ex’s and dividends not taken into account it does seem that they only use taxable income. But won’t take my word for it. check and ask for them to reconsider.

Police pensions are taxed in the same way as other occupational pensions. He would get the standard amount of tax free pay, I think it's £12570 and the remainder will be taxed at 20%.

It would appear that he receives a non taxable pension from an injury benefit. That, as it stands, isn’t included in the CMA. It is under review. Will report back.
