You’ll probably need a solicitor or can do it online

azuresky50 · 22/03/2025 22:43

If the marriage is recognised in the UK you can just simply get divorced by applying online through a "no-fault divorce". Depending on the complexity of your case you might need a solicitor or you could do it yourself and save a lot of money.
Islamically, through "Talaq" and waiting period.

Just get a solicitor, and apply for divorce. Forget the Islamic divorce for now, you just need to make sure you're legally ok and secure. He might get half of your house unfortunately, consult a solicitor asap
Good luck!

Solicitor, as suggested.

I was married in Egypt and as it was recognised in the UK I applied online and then paid a solicitor to do the financial consent order. It took about 11 months from start to finish so was not quick, but there was no special process for it being a marriage that took place abroad.

I did could of finished it much quicker by going out to Egypt, but he was not co-operative

Depending on how religious you are, surely you’ll also need an Islamic divorce- as far as I know you’re able to also apply for this from your end and not have to wait for him to divorce you? maybe somone else whos actually been through the process might be able to help.

however the legal side of things you’ll need to ensure you have all your paperwork- marriage certificate etc and apply online in the usual manner

ButterfliesnWaterfalls · 23/03/2025 04:53

If you divorce through English law (which is advisable) - then that would mean you are automatically divorced the Islamic way, as it would count.

Talaq in Islam is essentially saying you both don’t want to stay together. Once he signs the papers, then that would be his agreement to nulling the marriage contract.

I hope that helps.

ButterfliesnWaterfalls · 23/03/2025 04:54

Make sure you speak to a divorce solicitor as you have assets.

There’s no reason why he won’t/can’t claim your assets.

You can start the process online today - forms are available at the Gov.UK site.

You can do a DIY divorce. But cos you own a house and pensions, you better get proper legal advice about the financial settlements.

As it's a long marriage, unless you ringfenced the house somehow, he will likely have a claim on it whether it's in your sole name or not.

Go on line and fill in the forms, and pay the (just under) £600 . Then get a solicitor for financials.

approach your local mosque and request a khula, this ends the nikaah contract. Many mosques are reluctant to do this however there are some services online.
The legal divorce can be done inline.

I followed both steps after 20+ years of marriage, in my situation it was the very best outcome!

When you do it online, how do they communicate settling figures etc can he be emailed or do I need a postal address for him?

Just input as much detail as you can, I had my EXH address etc so used that information. We had a private financial agreement so didn’t go through the courts for that
