We have been married 12 years. I've always paid household bills as oh is bad with money. I've asked him to pay half but he says it won't leave him enough for beer and fags. I don't get anything left from my wages either. He lost his licence due to drink driving and wrote his car off now he's complaining cos he cant afford another car. I have an 18 year old fiesta so nothing fancy. Am I being unreasonable

Ask him to leave. If he won’t, get the court order and start divorce proceedings.

You're being unreasonable staying with someone who doesn't see you as a team and who wants you to contribute more to your combined life than them so they can have more disposable income, at your expense.

So tell the landlord that at the end of you tenancy you want to leave.
You can then renew it without him being apart of it.
But give him the option of either taking it on or moving out.

If you rent and your agreement is in your name only and you're in England you can chuck him out!

Then yes you can kick him out and ring the police if he refuses (obviously that's not ideal and the police might make it worse) but it's still an option.

What makes you believe you are legally obliged to bed and board another person forever despite the relationship ending?
Are you in the UK because I've never heard of that law.

@Horsewench are you in the uk? If the tenancy is in your name - and is definitely a sole tenancy and not a joint one I don’t think it’s a court order you need.

speak to shelter and they can advise.

OP is correct. You can’t throw a spouse out of the marital home without legal consequences. Even if he isn’t on the lease.

OP is correct because they are married it is considered the marital home and she can’t just kick him out. She’ll likely need to start the divorce and maybe get a court order.
