Hello,

my partner and I own a house together where we live with our 4 year old daughter. The relationship has now broken down and my partner has become quite nasty so I feel l need to move out. I live in a high cost of living area and would not be able to afford anything privately, especially as I’m only part time also due to lack of childcare and my child being autistic. My name is on the mortgage but I did not contribute anything towards the deposit (gift from partner’s family) so I would not get a lump sum there either. Has anyone else been in this position? What did you do?

We are joint tenants I believe, we did not specify anything like shares of the property when buying it

Joint tennants are entitled to 50/50 of proceeds of sale.

When you co-own a property as joint tenants, each co-owner owns the whole of the property and neither owner has a specific or identifiable share. If you sell the property, you are each entitled to half the sale proceeds regardless of how much you each contributed to the purchase price or to the mortgage repayments

Please ensure you pursue full 50% and dont accept less. You are going to need it for your child more than yourself.
