Will he get custody

Me and ex partner have 3 month old daughter

We are not getting long lately, for the past 6-7 weeks I'd say.

I recently had to get police invovled as I ended the relationship and he kept stalking me standing outside where I live and sending abusive threatening nasty messages.

He got locked up, went to court and his bail conditions are to stay away from me and to not contact me (he still contacts me but have stayed away from me)

I've stopped his contact with our baby as I don't feel comfortable her being in his care he's aggressive and a cannabis smoker.. also does other drugs

Now he wants to take me to court, he is on her birth certificate unfortunately.

A little background on him, he has a criminal record (been locked up about 20 times) for things like assault, drugs, and the most recent was stalking me.

He also doesn't have his own home and sleeps on his mother's sofa so I don't know where my daughter would sleep if she stayed over.

I'm worried about this going to court incase he does walk away with rights to have her overnight and more days than he actually does at the minuite (2-3 days a week) I'm worried thay if it goes to court he will end up in a better situation with our daughter than he already is in.

I personally don't think he deserves un supervised contact with her

Any advice please

Say she is fully breastfed. He won't be able to have her unsupervised until she's at least one. The court won't expect it.

Call the police about the fact that he still contacts you.

Were SS called?

Oh really, so what so they expect you to do if baby is under 1

You'd have to be there or he can only have her for very short periods like in between feeds. I can't see how they can enforce that right now because of his bails conditions so that would likely be a problem for the future.
Also bare in mind that bail can be extended!

I have never dealt with domestic abuse in particular
You might be eligible for Legal Aid.

Rights of Women also offers a free legal advice helpline

Also, if I were you, I'd move away as far as possible if I could before there is a court order in place. It will limit the overnight time he gets with her if he does.

Best of luck

Why would you start a family with someone who has been locked up 20 times? Why would you have anything to do with a person like that? I doubt he is to take you to court if he doesn't even have a place to live and a long criminal record.

What a sorry situation- the poor baby.

why on earth would you have a child with such a scumbag. He sounds awful.

I second what others said and move away as far as possible, possibly contact charities to see if you can move to a shelter.

You need legal advice but I would imagine that worst case scenario for you would be a contact centre.

Getting added to a birth certificate is very easy so don’t beat yourself up about that one. (It’s a form then dna if mum says baby is not his )

If he’s a druggie sleeping on a sofa, is he likely to take you to court? It costs him a mediation fee plus £210 (?) to get a Child Arrangement Order and it sounds like he’d rather spend that money on drugs.

BoohooWoohoo · 06/05/2024 11:36

You should also do the Freedom Programme so you can work out why you had a baby with a man with such a nasty disposition and long criminal record. If she’s 3 months old and you were pregnant for 9 months then you were together for over a year which must have your friends and family very worried and disappointed.

You should be letting the police know he's breaking his bail conditions.
