Unofficial loan in separation

I am separating from my partner of 5 years. We own a house together as Tennants in Common. Over the years I have paid off £62000 of his debts and he has always said the money would come out of the house in the end. Unfortunately it looks like there will not be enough equity in the house to pay back this money when the house sells. Is there anything I can do now to protect myself in getting this back. For context it would be around 3 years salary to walk away from. We do not have any children together. Having a mild panic and I know how stupid I have been to not have this in writing. All I have is a few texts and bank statements showing the funds paid to him.

You can try. There's an equitable agreement concerning property and some written proof in emails. Go in strong but negotiate to avoid court costs? Get a solicitor to advise.

Unfortunately legally you are owed nothing and relying on his morales. Anything given to him is classed as a "gift" legally.

Even if you had some paperwork signed to say he would pay you back it wouldn't stand up in court.
