Separation - how to deal with joint tenancy

My husband and I are separating. I really would like to stay in our home, but it is a joint tenancy. I think it is just about affordable as if he moves out I should get some housing benefit, and will no longer be getting clobbered with the minimum income floor on universal credit (because of his "business". How do I proceed?

Call your landlord and ask? Gather information first and ask them about the process. Then you can talk to your ex regarding it.
Is your ex willing to transfer it to you? Council houses and housing associations deal with it differently. Maybe give shelter a call and ask them for advice.

Talk to the landlord, either one or you can end the currently tenancy without the other’s permission if you are jointly named. Talk to the landlord and ask if he’ll end the tenancy and issue you a new one individually.

It's a private landlord not social housing. I just wondered if I have any right to stay on with my ds or if a court decides who has to move out.

When I did it I let the letting agents know that he's moved out.
And I'm still living there.
So I had to ask when it came up for renewal can it just be me on.
Unfortunately I had a much lower income.
So the landlord then wanted a guarantor.
I was in the fortunate position that I could give one though.
So I just had a new tenancy agreement with my name and had a guarantor.

I just emailed ll and said I had thrown him out! Got a single tenancy through the post that week! Then claimed relevant benefits.

I have a friend who told her landlord and he told he couldn't do anything yet. She had to wait until the current tenancy ended, the landlord then issued her with a new tenancy. They didn't have children and her ex wanted to leave. So it was straight forward for her. Especially, since she only had couple of months left from the old tenancy.
