Hello,
Can anyone enligthen me on how to go about a diy divorce in Scotland?
Apparently you can choose either Sherriffs Court or Court of Session , but cant find any info on what the difference is...
We are both agreed, have children over 16 so diy should be possible hopefully.
Any advice much appreciated!
Thanks. x

The Scottish Court Service and Scottish Citizens Advice Bureau both give useful advice about the Simplified (DIY)procedure. You should take advice from a solicitor or Citizens Advice Bureau about the financial aspects before trying to DIY. You need to sort this out before you apply for a divorce.

You apply for a DIY SImplified Divorce using your local Sheriff Court. You would only need to use the Court of Session if you weren't settled in any particular part of Scotland - e.g if you were a Traveller moving every few weeks .

If you are really hard up,you can get Legal Aid Advice & Assistance to advise and help you with the DIY procedure. If the DIY procedure is not suitable, you may well be entitled to Civil Legal Aid to use the Ordinary procedure, which needs a solicitor.

I have to recommend them, you pay £250 but they literally talk you through everything and I had a few things that had to be altered through the process and they were minutes away from answering emails, can't recommend them enough. I've probably spent no more than £600 in total for everything

Thanks for the info guys, very helpful! 👍
We are agreed on everything and have all finances split already as we've been separated for 2 years, waiting for our youngest to turn 16. So hopefully it should be a straight forward procedure.
Thanks for the advice, much appreciated!
