Names when married

Hi I've been with my partner 10 years and we have had two children together, sadly our first son died after a difficult birth in hospital at one day old. Our second son is happy and healthy little 2.5 year old we have lived together nearly as long as we have been together and have a house together. But we aren't married just engaged. We have discussed getting married but made no definitive plans it's been a roller coaster few years our second son has my partners surname but starting to wish he had both our names. If we get married and I take a double barrelled name will my son get one too ? If so would his birth certificate have to change? Thank you

your son's name won't automatically change when you get married. you need to officially change it by deed poll. that won't change the birth certificate, only future documentation.

It is sad your first son died when he was one day old after a difficult birth. I am so sorry - so traumatic and painful.

I'm a registrar. When you re-register your 2nd son after marriage his surname can be changed to either of yours or a double-barrelled combination. He will get a new birth certificate which will replace the original and the original registration is effectively sealed so that no more certificates can be issued from it. You need to re-register but it's free, just £11 for the new certificate.
Any name change not done at re-registration would need to be a name change deed (typically called deed poll).

@WOPTF this is so so useful, I couldn't work it out reading up on line how it would work. But what you have written is a very clear explanation of what we would need to do. Thank you so much 💜

After our first son died, I hadn't decided on even first names let alone surnames for our second son when he was born (just my way of coping with pregnancy and birth after our sons death a year earlier) looking back now it's all a bit of an emotional blur getting him registered and picking out names, so hadn't thought it all through properly.

I can work out properly what we want to do now so big thank you everyone and much love xxx
