Alcoholic ex breathalysed but passed?

How can this be?

I was sure he would be over the limit.

He came this morning to get his work stuff which hes storing in ny garage (he just toook the key when he left) and absolutely reeked of alcohol. This is the reason we split a few days ago; his drinking.

Anyway, he said he'd got bored at around 7.30pm and went to get 2 bottles of red wine (he always has 14%, no less) which he drank.

Given how he usually drinks, he would have had finished them both and been asleep by 11pm at the latest but he just sent a sarky message saying "breath test says I'm fine"

He's drunk 2 bottles of wine and a few beers every day since I've met him and yet passes a breathalyser? Crazy.

I did hope it would be a wake up call but obviously not :(

Who conducted the breath test?

Is he just doing them randomly?

No, I reported him to 101 as he was on his way to work and I could smell the alcohol on him from 6ft away outside.

Felt awful but he can't drive drunk (as I thought he was doing).

Turns out, negative test.

At least I know he won't hurt anyone.

Are you sure he is telling the truth? It could be that he wasn't actually breathalysed or that he was and didn't pass but is lying to you about it.

Maybe its his clothes that smell of alcohol.

So the test was next morning? Quite possible that he passed- we all metabolise alcohol at slightly different rates, an hour a unit is only the average. He could still smell of booze.

He could be lying to you about not passing or it could have passed through his system.

And he guessed you reported him?

You might need to be careful because if you keep doing that, it could be harassment. While it’s right to report if you think he should have been over the limit, you need to be careful.

He was clearly under the limit. I am sure I hear that heavy drinkers can metabolise alcohol quicker.

Its also possible he lied about how much he drank to wind you up.

I'm not sure I'd believe him - either he didn't drink 2 bottles or he didn't pass
or if he was tested at say 10am, then he should pass.

Yes, he didn't leave here until 8.50 while I was on hold to 101, he messaged me at 9.50 so must have just been stopped.

I hopefully won't be seeing him again after today so won't need to know whether he's drinking and driving or not anyway, therefore won't be reporting him again.

So he left at 8.50 and while you were on hold to 101 the police located him and pulled him over and did a breathalyser test while you waited? Because the police do that all the time don't they....

How on earth do you even know if he took a test?

I came off the phone to 101 at 9.03, well I assume it was 101 but they transferred me over as 'priority' after I'd explained the situation.

The operator asked when my ex had left (5 or 10 mins prior), I gave his reg details and where he had told me he was going for his first job (just the town name) said he'd put a call out and try and locate him.

Then at 9.50 my ex messaged saying the breath test "says I'm okay" I hadn't told him I'd be reporting him so assume he must've been stopped.

I think the vast majority of people caught "the morning after" have in fact had an early morning drink bit don't want to admit it.

An average man would metabolise 2 bottles of wine within the timescale you posted (approx 10 hours since last drink) enough to pass a breathalyzer.

A small-framed woman, probably not.

And yes to most drink driving "morning after" incidents actually occurring after morning drinking.

Important note: blood/breath alcohol level is an objective measure. It doesn't indicate whether someone is actually impaired. I've known people have one drink on an empty stomach and be too drunk to drive competently - but pass a breathalyzer.
