Divorce cancellation

I applied for online divorce at weekend after too much alcohol (I will not be drinking again) and an argument with hubby.
I'm panicking now and have emailed the gov website but does anyone know if it will be easy to cancel application as it has not been served to my husband yet ? I paid £593 by credit card which I'm hoping can be refunded 😳

Confused

Nobody gets drunk and wants a divorce.

What’s the rest of the story?

Joystir59 · 17/01/2022 07:29

You did what? That can't have been a random drunken thing. Draw breath and work out what's really going on for you and what you really want to do.

How ridiculous

Sarcobaleno · 17/01/2022 08:22

Go back on the website and read what it says there? Or read the email you were presumably sent?

PicaK · 17/01/2022 08:41

Well more fool you if you dud it out of pique. If he's any sense hell agree the paperwork and the nisi will ping its way to you soon.
At that point (after 43 days you and 3 more months him) you can both apply fir the absolute. Maybe that will focus your mind in drunken incidents.
Otoh if you weren't just pissed off as a one off then go for some counselling. See if your subconscious was actually telling you something and showing you what you need.

You don't apply for a divorce after one argument.
Have you got cold feet?

Maze76 · 17/01/2022 09:33

If you applied via the portal, online, then do not worry! Yes you can cancel the divorce at any time during the process, however you and your husband both have to sign a document agreeing to the cancellation ( I forget what it’s called).
The Nisi is no longer automatic, you now have to apply for that yourself using the portal, if you do not then the divorce process will not continue and there is no time limit on this, so in theory you could wait years without applying for the Nisi, therefore the divorce will not progress.
However, it may be to your advantage, at this time,to take no action either way- as others have said the fact that you applied in the first place speaks volumes. Perhaps take some time to really think about what it is you want & why you applied in the first place?
