Abusive marriage - options?

Hi, I will seek advice through the proper legal channels but wondered if anyone had first-hand experience of leaving an abusing marriage in Scotland. My sister and her husband jointly own a home, life is now intolerable for her but he is refusing to sell. If she leaves to stay with family does that have an impact on her claim over the owner house? There are no young children involved, youngest child is in his thirties.

Any advice would be much appreciated.

It should not impact on her entitlement to a share of the property.

You should always tell someone to leave an abusive relationship. It’s too dangerous to stay.

The house will get sold. But he can delay the process. However it’s still better that she leaves and forces the Sale. I expect if she stays he will use other delaying tactics. Focus in her getting the legal action moving.

Thanks so much for your reply. So if she comes to stay with family she can force a sale from there? I'll make an appointment with a solicitor in the next week or two.

He will definitely do anything to make it harder.
