Seperation - HELP

Morning All.

Wondered if anyone could give me any advice on where I stand legally.

Me and my husband together 17 years - married 7. I moved out of our family home 1 year ago after being in seperate bedrooms for over a year. We have 1 child together. He wouldn't leave and I couldn't continue as we were so I moved in to a rented property.

I have not contributed to the mortgage for the past 12 months but my name is still on the mortgage.
Do I still have a claim for half the value of the house? How does it work when I was the one to walk away?

Any advice much appreciated. Thanks 👍

I think it would be best to speak to a solicitor and they will advise you - some employers offer employee assistance helplines (which includes legal) so you could try and access it that way, otherwise arrange a free consultation- you'll need how much is the property worth, how much equity is in it and what the preferred financial split will be (usually starts at 50/50) hope that helps.

For me when my ex H moved out, he stopped paying anything towards the family home, yet this didn't make a difference when we settled the finances over a year later.

I've called a solicitor this morning - just waiting for a call back.
I'm not bothered about rushing for a divorce to be honest- happy to wait for the 2 years seperated and then apply but I obviously want to protect myself financially - if I ever hope to get back on the property ladder then I will need equity from the house for a deposit. Just wondered where I stood legally.

You will be entitled to half the equity at the time that you moved out.
