Ex might stop child access during Tier 4

Hi, I think my ex is trying to stop contact with our son due to Tier 4 restrictions. I had my final hearing on Wednesday and now have a child arrangements order. I saw him for the first time in almost seven months on Saturday which was also the day tier 4 restrictions were ordered to be put in place . Its been hell getting this far and now I am waiting for her to give her excuse as to why I can't see him. I only see him for one hour every Saturday at the moment. I have informed her that nothing has changed since the first lockdown and parents can still see there children . I take him to the park which is close so I'm not moving him around.

What happens if she chooses to ignore government guidelines and breachs the court order?

I have no advice but my heart really goes out to you. Its an awful awful situation esp when guidelines have been clear for a long time regarding split families.

Have a paper trail -email and text. Copy and paste the link to government advice about contact for parents. State clearly if he stops contact he is in breach of the order. Courts do not like parents acting above the law.

Even! sorry. Also copy in her solicitor if she has one.

If she doesn't make the child available you can also log it with SS and police -that she is in breach of the court order. Be calm.

Where is your collection point for an hour? You need evidence that you went for contact. So either a witness -or a third party etc.

Eg I arrived at the park at 9.50am for contact at 10am -I waited until 11.15 am child was not available.
Text at 10am -where is x -I am at the park at arranged in the court order.
Text at 10.15am Further to my previous text I am waiting at the park etc........
Text at 10.30am
Text at 1045am
Text at 11am
Text at 11.15 am -I have been waiting since 9.45 am for my contact from 10-11am today Monday the x of December @ the location of This Park. My son/daughter was not made available which is a clear breach of the order.

Keep communications in writing, text is fine. Be factual with her, send links to the government guidance. The moment she says no, contact your solicitor. In fact I'd ring them today so they can advise you what to do.

Hi all, thanks for all the advice so far. I only have a court order for my son, it's for one hour every Saturday, no set time or place for one month and then increases every month thereafter. There is no court order for our daughter as I have regular access and the courts were happy that we are doing a good job with her. I have her every weekend and also weekday visits.
