Hi. Can anyone advise on how long it would take from putting in an application into the court for access to the other party hearing.. Explained.. My exp has threatened court proceedings for contact with DC.. It's been two months and so far nothing. My solicitor hasn't heard a peep. I've heard he has no legal representative.. Would it take longer than two months for me to hear??

You’d hope not, but there’s a hell of a backlog following all the Covid closures. I guess there’s a remote chance it’s gummed up in the works.

Have you had mediation? If not then a mediator has to sign off before a court will grant a hearing. If he is the applicant then he will need to obtain sign off. Does he have a solicitor as I would expect his solicitor to write to advise on proceedings. He could apply himself but timeframes is very dependent on court. You could phone the local court to ask about timeframes.

Thanks both. Basically he's horrifically abusive and violent so we are way.. Way.. Past mediation. My IDVA has exempt me from mediation.. He has no legal representation because he can't afford it and is representing himself.. So not sure how it's going to pan out. Basically the most he will ever get for an extremely long time is supervised visitation in a contact centre... I don't even want that I'm quite happy for him not to be part of my daughters life any further.. But it's not about what he's done to me.. It's about my daughter and her welfare and if you ask me if I think he's a risk to her.. Then I'd say yes.. Categorically.

Tbf he would be advised by the court to have representation in regards to any petition he may wish to file. This could be expensive for him taking into consideration his previous violent behaviour which you would challenge. Be ready for any hearing - Evidence, dates, photos and journal or log, witnesses - prepare just in case

Thank you. Yes I have everything.. I will also have the police records adding weight to my case, he was arrested multiple times for attacking me, once when I was heavily pregnant also.. I think he has it in his mind he's going to get 50/50 residency.. Social worker absolutely detests him and has made a recommendation in her report for no contact at all
