Getting ex partner out of house

NC for this and writing on behalf of my DM, who I am worried about and desperately want to help.

DM has been in a controlling relationship for the last 10 years. She has tried to end the relationship numerous times, he always becomes violent and the police have been involved. She has always dropped the charges and taken him back as she is scared.

She has built up the courage to try and leave him once and for all, but is worried how to go about it. The house is hers, just in her name, he does not contribute towards any bills and is not named on anything apart from the council tax. He always refuses to go when asked, ignores any notice she gives and will become very aggressive.

Does anyone have any advice of the best way for her to go about this?

Has she spoken to women's aid? She needs a Non Molestation Order.

That basically makes it easier for the police to arrest the ex if he tries to re-enter the home.

You can apply for an ‘injunction’ if you’ve been the victim of domestic abuse. An injunction is a court order that either:

Protects you or your child from being harmed or threatened by the person who’s abused you - this is called a ‘non-molestation order’

Or
decides who can live in the family home or enter the surrounding area - this is called an ‘occupation order’
The person named in the injunction can be arrested if they break it.

We're not getting the full picture here OP and it never is when given online.

The police have the power to remove him for 48 hours which can be extended to 28 days. In that 48 hours, she can apply for an emergency Occupation Order which is an injunction that regulates the family home.

An Occupation Order is usually combined with a Non Molestation order that keeps him away from her.

The problem is, is she ready to leave? The police may have already informed her of this and she may just be telling you what you want to hear.

She can get all this combined with the Sanctuary Scheme which is where her house can be checked for safety and the locks etc changed. It's borough dependent so she needs to check if it's in her area.

She can contact Shelter for advice on the house, her local domestic abuse organisation, Rights of Women or FLOWS for more advice. And of course dial 101 and speak to the police.

Are they married?

If not then just change the locks. Speak to the police / WA if you think she will need support.

Sorry for the delayed response and thank you for your replies.

They aren't married. She is very reluctant to speak to women's aid. We will have a look at non molestation orders tormorrow.

Temporarily until you get a non-mol/occupation order (please get advice on this, I don’t know if she needs one but pp on here tend to have experience so could well be right), she can change the locks.
