Can he change the locks?

My husband and I are separating. It’s his name on the mortgage but not mine, but my 2 children and I are still living here until my rented accommodation is ready in 3 weeks. He has said today he’s had enough of me living here so tomorrow while I’m at work and the kids are at school, he’s going to change the locks. Can he by law actually do this?

No, he can't. You can actually get a court order to get a copy of the key, too. It's not legal to do this and you need to make him aware of this.

He can't wait 3 weeks for you to move into rented? What a bastard! Is it his plan to lock the kids out too? I'm outraged on your behalf OP that he would even consider doing this.

If you've been married some time the house is surely a marital asset no matter who's name is on what - see a solicitor anyway, don't take his word for anything if he's the kind of human willing to see children he's lived with for presumably years homeless!

Is he seriously not planning to let the children in after school. I assume none of them are biologically his? Nevertheless he's been in a parental role surely - no decent person would kick them out with nowhere to go when they're set to move out in 3 weeks anyway.Sad

Can you work from home?
And it is illegal to change the locks.
If they are his kids and you have been married for a while then that house is 50% yours!
Not sure how busy they are right now but you could try 101 and get some advice from them.
But get a solicitor quick sharp.
Do you have somewhere you and the DC could go?
Do you have a back door key you could take so he can't lock you out?

Don’t leave the house tomorrow. Get legal advice. You can register interest in the property.

So he didn’t end up changing the locks so we’re still here. He is still saying he’s going to do it tho so I will in the meantime take a back door key with me.

Sounds like he is using scare tactics. Putting you and children out on the streets will make him lookk very bad. Is he the sort that cares what others think of him? If so, I'd wager this is just to worry you.
