How to leave - renting

Hi

i have decided to leave my abusive partner however i am 4 months into a 12 month tenancy, how do i get out of it?

When I was in this situation and found somewhere else to go I moved out and told the landlord the same day that he would solely be responsible for the rent.

Depends on when u are leaving. Officially your give notice as stated in the lease then just move out.

Or, depending on how much notice is required, you could tell them to keep the deposit for the period you are leaving early? Youd need to ask.

You may be able to leave early if you cite domestic abuse and have a police ref number as well.

Talk to your landlord first. Worst case you leave right away and owe X months of rent for lack of notice and if your ExDP pays it, he can take you to small claims. If he doesn't, the landlord can. Depending on where u are, you could then make a repayment plan during mediation.

You need to read the tenancy there is usually something called a break clause

Basically you tell the LL that you have left and depends on what is in the contract.

Usually they will just either do a new contract for the person who is staying as this is better for everyone and no loss of money, or they will terminate it entirely and you could be liable for the rest of the rent.

I was in a 12 month contract and left early and I negotiated with the LL they rented it out immediately so it was all ok in the end. I did have to pay an extra month to them but this was part of the negotiation

The deposit will need to be sorted though as will be in both names. Which is why if he stays there he will need a new deposit with the new contract as it belongs to both of you

You can’t tell them to keep the deposit it is protected. The deposit has to be released and can take 10 days
