My husband of 44 years has been seeing another woman and I want a divorce, he is 73 and I am 70. Our house is worth £500,000 so I will need £250,000 to buy him out. My daughter has a house which is worth that. Can anybody give me any advice that can help me out... Any help would be greatly appreciated.... Thank you so much.

Maybe buying him out isn’t the best thing.

I’m assuming you home is a family home which you probably don’t have a need in terms of rooms etc.

That’s just my take though. Smile

You will be entitled to a huge amount of his pension.perhaps you could use that as a bargaining tool....you MUST get proper legal advice before you agree to anything x..

I realise this, but at my age in life I am happy where I am and I think i will struggle with a move

Do you have a good income (pensions/investments?)? Do you have savings? If you don't, then you can't buy him out.

Oldiedivorce · 04/06/2019 19:48

Would he not also be entitled to half my pension as well though.?

Well yes, that's a point. Maybe the split wouldn't be 50/50 in a divorce. You need legal advice.

hellodarkness · 04/06/2019 19:49

See a solicitor. Nobody online can give you accurate advice, every situation is unique.

You are obviously entitled to at least 50% of all assets, so think about savings, investments and pensions.

I can't imagine that buying him out would be the most financially sensible option but you'll certainly need a solicitor for advice.

I personally wouldn’t use my daughters house to keep me in the family house - I think you should consider downsizing, visit some options

Unless you've got £250k in other assets, you won't be able to buy him out. Sell up and go your separate ways. If your pensions are of equal value, it might be relatively straightforward.

Are you wanting your daughter to sell up and move in with you ?

NC4Now · 05/06/2019 09:55

I don’t really see that the daughter’s house is relevant, unless you bought it for her. Has she offered it or something?

In divorce, all the matrimonial assets go into a pot with a 50/50 starting point, then they make adjustments according to need.

What’s your husband suggesting?

Get some legal advice and consider downsizing

Divinelyuninspired · 05/06/2019 14:15

Have you discussed it with your daughter? The only way that is relevant is if she sold up herself.
