Leaving the family home

Hi there,

Im looking for some advice. I intend on petitioning my wife for divorce on the grounds of unreasonable behaviour.

She has recently told me she would like to separate just 12 days after my mother passed away. I also recently found out she is using an online dating site for single parents even though we are still living together.

On top of this, she has told me she doesn't love me as a husband. She has also completely drained the joint bank account even though I have a very reasonable salary coming in every month (she doesn't work).

The problem I have is that I know as soon as I tell her, she will get very angry - she has already been verbally abusive to me on several occasions and grabbed me by the throat on one occasion.

What are the options here? I've been advised to not move out of the family home whilst the divorce is under way. But what if things turn nasty and she is verbally or physically aggressive? I need to think of the legal implications as well as my personal well being.

I'm going to ask my solicitor this question on Monday but ahead of that I wanted to see if anyone had been through a similar situation.

OP I'm so sorry you're in this situation. No-one should have to live with the threat or reality of violence. Ordinarily you can apply to a court to have your wife banned from approaching you based on her past behaviour but given the income / child care arrangements i have a feeling it isn't going to be straight forward.

There are definitely Ps on here who will be able to advise you until you see your solicitor.
