No idea, but I’d assume not as they weren’t married. She might be able to argue something if she contributed to the mortgage or running costs. Worth a quick consultation with a solicitor I’d imagine.

She maybe able to claim something. But unlikey she will be able to remain in the home. The kids are largely (For legal purposes) irrelevant because they are not dependants. She needs to start making plans to get her own place and get legal advice.

Notacluewhatthisis · 25/09/2018 07:49

Are they his kids or their kids?

AttilaTheMeerkat · 25/09/2018 07:51

If the property is owned by him solely he is well within his rights to ask her to leave the property. The law sees them as two individuals who are unrelated to each other and will be treated as such. Her rights in law are few and she may well walk away with nothing here.

They are their kids and they were not married , I dont think that she will be able to prove much of a financial contribution towards a deposit etc

You say they have been together for 28 years. The way you have posted the comment implies they are his adult children. How old are the children (!) ? I should think she would need to prove that during that time she has contributed to paying the mortgage ( not just by renting) and even then it might not get her anywhere.

She needs to see a solicitor. There's a lot of case law on constructive trusts which she should be able to use to show that she had an interest even though she's not a legal owner, but she needs proper legal advice.
