Advice re Divorce

Hi, question on behalf of sister please ((Scots law applies if relevant).

They are over 2 years separated, house sold proceeds split etc just divorce to resolve. He had Solicitor commence proceedings, sis received papers, not challenging as everything amicable (they just wanted different things). And now, nothing! Papers were issued in July and she hasn't heard a thing since. What might the hold up be?

Sorry, forgot to add...she contacted the Court with ref number on the papers and Clerk advised it's in a 'dormant ' state, but can't say why?

Hi I can't help there is a separated/divorce thread you may have better luck posting there.

Treacletoots · 31/03/2018 18:31

Has she received the decree nisi? Sounds like she should have by now. It can depend on how busy the court are busy usually 2/3 months max?

Mum4Fergus · 31/03/2018 19:02

Posted there but no replies Blush she's heard/received nothing since July. Questions to her STBXH are not being replied to.

Very odd. I've no idea.. I'm sure she could move it forward even if she didn't petition into the first place.

I'd get her to phone the court and ask them how to progress. I did and the court were very helpful. (And free)

That's useful Treacletoots, thank you!

Is it possible that the hold up could be down to him not paying his legal bill? We're aware he has sold a house at a loss so may have money issues...
