a question for those that have had legal representation and are claiming benefits.

can you tell me if your solicitor advised you to claim working tax credits/child tax credits did they know the eligibility rules or did they just tell you to apply and to see whether you would get anything.

the reason for asking is all the way through my divorce process i was told to apply for these - due to the complexities of my case and the fact that i had other money to live off this wasn't a priority pending the outcome of the hearing.

as it is i was employed by my X's business as a "tax dodge" (his words) but received dividends. I believe the dividends i received put me over the threshold but regardless of this my "employment" would cease on divorce as all solicitors mine and his would know.

however the assumption that i would receive tax credits was heavily used in the final statements prepared by the other side and this information was obviously incorrect and no doubt impacted on the judges final decision.

just trying to see if there's any way I can resurrect the shambles of my case

badhatter - im not sure this is relevant to my question but took this into account when awarding minimal spousal maintenance

I think the two ran parallel for me at the time if it makes sense. I didn't seek spousal maintenance though, neither did I have dividends.
