Has any one took on the local authority social works on in court and won

Hi I'm a mother whom hasn't had my daughter in my care for over a year due to social services using my learning disabilities mental health and my fibromyalgia against me. I have found the social worker to be rude bias and broke confidentiality by sharing information to a 3rd party I've fighted them for months on end and exhausted the complaint procedure the thing is that the local authority are lodging a petition in court for a permancey order under section 80 of course I've apposed the order and I'm asking for my daughter to be returned to my full time care I'm not the monster they are making me out to be Yes I made a mistake but only cause I was under so much pressure and was getting abused by my family whom I have no contact with can anyone advise what my chances are

Whatever has happened and is happening, the one thing you can do to support your appeal is to engage fully with all the agencies involved, work with them. They want to do what's best for your child, prove to them you are what's best. Listen to them, they are highly trained professionals, they arnt out to get you.

She is 9 but has disabilities the police don't always get it right the person who reported it stated that she set me up cause her son was bulling my daughter so I reported it to the education authorities even my lawyer said that she had a vendetta agaist me she was also charged with perverting the course of justice along with her so called pal

A child psychologist stated that my daughter was being brainwashed by my mother as when she assessed my daughter in my mum's house she stated that my daughter didn't seem happy in the home the psychologist stated that my daughter was asking to come home on more than one occasion I was also never giving any parenting assessment so I started going to some in my local area done a lot of child care courses and one that deals with children with special needs

In my experience, and having worked with social care for a while and also my best friend being a child protection social worker, I've never known a court case be summoned for permanent residency and not go ahead.

It costs approx £1000 a week to put a child in to care. If they had any intention of allowing her to come home or believing they wouldn't win the case, she'd be at home now saving the local authority masses of money.

I'd say it doesn't look good here. My friend's sister, who rightly had her children taken off her, had her learning difficulties used against her as the main reason, too.

I'd say invest in a good solicitor if you want to strengthen your chances.

If you want to appeal against conviction, that's the Court, not the Police Commissioner. How exactly were you "wrongly charged"?

I am a retired social worker/manager with some 30 years experience in children's services. Can I ask OP - are you in Scotland because their child care law is different from the rest of the country and I have no knowledge of it.

I have never heard of the social services "going to court to lodge a petition for a permanency order under S80" which is why I think you must be in Scotland or even overseas?

I think you're getting lots of questions because it isn't exactly clear what has happened but it may be because of your learning disabilities and your mental health problems you are not able to express yourself as clearly as you would like and are in any event a bit confused about the whole thing. That's not surprising when you are on your own battling people in authority.

IF you are in the UK I can help with explaining child care law and your rights in the process so can you post again and tell us whether you are in Scotland or another country.
