I'm getting a regular on this site now ?? always asking for help
I wish I'd have found you sooner and maybe I'd not be a skinny shrivelled woman with all the stress I have endured over last 14 months and 9 court cases later
I would love everyone's opinion on this matter good or bad please !
I really want to use my maiden name again, I still use my husbands name because of my son .
I sat and explained this to my DS and he was really upset
I explained that mums have one name and dads have another then you came along and had daddies name .
I said what about having both our names and he thought it was a great idea
I asked my husband he as expected said fk off !!
, our DS will have a double barrelled surname with my name being the middle name . So really I'm not changing his identity I'm just making him feel secure and loved. Obv his feelings are the most important l
I explained this to Cafcass and they are backing my request. They called me and asked why and understood I believe .i
It's in their report saying they agree with my reason and its to be proposed at court at end of month along with proposed unsupervised contact l
Has anyone else succeeded in doing this ?

I've just changed my daughters name through deedpoll. Didn't need ex's permission due to DV and the fact that he no longer sees her. No questions were asked and it only took a few days.

If your ex has PR, the ONLY ways you can get a name change are with his agreement or with a court order. You can get a deed poll but it is not legally valid.

Bellemere is right, I've got a friend going through a similar situation and she's found out that the name change via deed poll isn't legally valid. I did try telling her at the time but she knew best apparently.

She no longer has to use his name in any official documents which is good enough for me!

Confused I have never heard of the 'mothers name, fathers name' rule, my DSS has fathers name mothers name. Where did you hear that from, Snowflake?

I've just had he passport done with her new name and changed her name with doctors..... Surely they wouldn't allow that if it was illegal?

They shouldn't have allowed it but it's not unheard of for mistakes to be made.

Its traditional to have it mother-father but I am not really wanting to get into a debate about what way round it goes

Umbongo it states on the deed poll website that if DV has occurred then permission isn't needed for a change of name. They do ask for any court orders stating this to be sent as evidence this has occurred. This is from the .gov website.

You could get his name changed to 'known as....' At school, doctors and so on. It won't change on passport but he will then be known by that name. My mum did it for me when I was a child and I have done it for my child because he wanted my name.

There's no such thing as a known as name. Again, a school or doctors may do it but they shouldn't.

I did. School, passport, NHS all know DD as my maiden name. ExH didnt agree to it. No court battle no drama I just stop using her birth name (on advice from solicitor).

Scottish law is different to English law on this I believe. All I had to do was write the appropriate letters as and when it was required.

Well I was successful the judge Cafcass and psychotherapist backed me.
My son now has a double barrelled name with my ex husband having the last name.
Judge was amazing and backed me all the way
My ex however had steam coming from his nose !!!!
My little man is happy and whatever he decides in the future I will back him

You've lived up to your name and it's amusing gratifying to picture the violent twunt fit tied up by Cafcass before the judge put a bow on his head and sent him packing.

Way to go, you! Your victory won't learn him but it'll cause him to be fit to be tied for some considerable time. Grin
