Childs Name Change without consent of father

Hi All, I have already changed my DS' surname by deedpoll, but I would like his passport changed to (ASAP if possible) but...

  1. my ex was abusive, he made threats, reported to the police etc
  2. hasn't had contact for 5 years, never paid child support or asked for contact.
  3. I don't know his whereabouts

Has anyone gone through the courts with a name change without the fathers consent? How did you do? Was it a long process? Any advice?

whatwherewhen I have been told I don't need one either because I hold sole parental responsibility (based on 2003 amendment) because my DCs father refused to put his name on the birth certificate and has no contact. This from a solicitor.

If I was to change DCs name right now via deed poll then apply for a passport they would only require the original birth certificate (to see who has parental responsibility) and the deed poll itself. There are no other orders in place, no court orders, contact orders etc etc so it will be straight forward for me.

However, if both parents are named you do need consent and/or a court order. in the case of the OP with there being abuse and no contact the court order is the only way to do it and should also be pretty straightforward too.

Bellemere.....my deed poll documents are legally valid and were obtained without a court order, consent and with his name on the birth certificates.

They were accepted as legally valid by the passport office to change passports.

Mistakes are made and these invalid deed polls are accepted when they shouldn't be.

Hi need some advice my son & his ex are having a baby in March (my first grandchild) as much as they have split my son feels as if she doesnt want him to have any say in what happens with child for example (she said she will name the baby whatever she wants) he has already been paying for this unborn he also wants to be on board 100% but it just starts an argument I would like to know if she can name the baby whatever she wants on the birth certificate(surname)as he really wants his name on it & sign it declaring he is th dad he is so confused with her as there’s no reasoning at all x
