Irretrievable breakdown. Is this wording sufficient?

I am divorcing my abusive H but don't want to put anything in the paperwork in case it antagonises him and he refuses to sign the paperwork. I am paying for the divorce and every penny I spend means I will have less to put towards my new house.

Is this sufficient grounds in the experience of others who have gone for divorce?

My husband and I have not been happy for at least 10 years. We do not share a bedroom and have had no physical contact for that time. We have had separate bank accounts for several years. We buy and cook our meals separately. We do our own washing. We do not socialise together. We have completely different social and political ideas and we argue frequently about this and issues like housework. This bad atmosphere is affecting our health and I feel increasingly depressed living with my husband

What does your solicitor say?

Antoniabegonia · 11/09/2014 12:42

Ive not spoken to a solicitor yet. I am going for the cheap option of paying the court £410 and they will guide me through the process. I will need a solicitor for the financial order, but with no children and no major issues (yet) of dispute I am just looking at a DIY option.

2 solicitors on legal Thanks have said it needs beefing up for UB so I will work on that. It will be harder to go down the 2 years separation route I think.

Some solicitors will let you have a free initial consultation. It's worth getting advice.

sillymillyb · 11/09/2014 12:56

Im no expert, but I'd maybe remove the last line about living with him making you more depressed. The rest doesn't seem to apportion blame, and if you are trying not to antagonise him then that's the only line I could see that might.

Good luck Smile

You really need to see if you can get legal advise.

I'm not sure that things such as seperate bank accounts is appropriate.

Antoniabegonia · 11/09/2014 13:14

I'll ring around to see if there is any free legal advice but 2 I've approached don't offer this any more. The court official was very helpful so I'll ring her too.
