DH has a pending court case, and didn't tell me ........

The amount of points on DH’s driving licence, and his failure to disclose them to me, has always been a bone of contention.

I’ve often found paperwork showing he’s received a fixed penalty notice for speeding/talking on phone whilst driving, yet he’s failed to tell me. On one hand, the amount of points on his licence doesn’t affect me, however it’s the insurance implications that scare me. He’s a named driver on my car insurance, and if he had an accident, and we hadn’t made the insurance company aware of his latest set of points, then I’m sure they would refuse to pay up. And I suppose the same would apply to his van insurance (he’s a builder). It always seems to be that just as one set of points is set to ‘expire’, he gets another set.

As far as I’m aware, he has 6 points, but at the weekend I found a letter from the police, saying that he’d been stopped for speeding (again), that the matter “cannot be dealt with via a fixed penalty and will therefore be referred to the Court.”

When I challenged DH over this, he said he “didn’t want to worry me.” Which is man-speak for “if I’d told you, there would have been a row.” He says he hasn’t heard from the Court yet. I don’t know if I believe him or not. The letter was dated Feb 2014, so I’m thinking that if the police were going to pursue this, he would have heard by now. I asked him to show me the paper part of his licence, and it still shows 6 points, so maybe he’s telling the truth about not having been to Court, as I’m sure if he had, he would have been given more points.

However I suspect that if he HAD heard from the Court, he would have failed to mention that too. And this is the bit that drives me up the wall. It’s not the fact that he got caught speeding (although I’m not particularly impressed about that) it’s the point that he has been ‘court case pending’ and didn’t tell me. All court cases are reported in the ‘court file’ in our local paper, you can guarantee someone would have seen it, and I would have heard via the grapevine. And this is also with the background of previous failures to be honest about driving endorsements. I’m very tempted indeed to take him off my insurance policy, as I just can’t trust him to be honest about his driving history. However it would cause us some real logistics problems if he couldn’t drive my car, not to mention that I wouldn’t have such a nice car if he weren’t paying for it ……

Any suggestions? He’s said “sorry” and wants to move forward, but I don’t feel we’ve got to the bottom of this.

If you google his name, will it show the court file from your local paper?

I've just done that, and his name hasn't come up. So I think I believe him that it never actually got to court (or at least it hasn't happened yet).

why doesnt he have his own insurance?
surely if he uses his van for work he needs to

Yes - he does have his own van insurance. And if he's not honest with the van insurance company than that's his problem, but my (separate) car insurance policy is a concern to me, not to mention the 'deceit by omission.'

Dh had to go to court after a minor misunderstanding over points. it took from February until December to get there. also the fact that you found the paper part means nothing - very common to report this as "lost" to dvla get a new one, send that to the court and keep the old one as "proof" of only having 6 points. it would not stand up to any detailed scrutiny but some...

I've an employee (who drives as part of his job) who appears to be doing his best to lose his licence by accumulating points and has a court case coming up.

When I phoned the insurance company they said they only need to know about new points at renewal time, as long as it was correct at the start of the policy and you update them before you renew it, it's fine.

The matter cant be dealt with my the court EITHER as its
a) speed over the +19mph fixed penalty band OR
b) he is a totter and facing a 6 month mandatory ban for getting 12 points.....

Does it say he HAS to appear?

Surely not every court case is in local rag - it would take up masses of space if so.

The letter says something like "the matter will be passed to the court for consideration and you should expect a summons in due course" (or words to that effect).

Our local paper has a 'court file' with the name and address of those who are found guilty at the local magistrates court. Its only one sentence per villain ......
