Our marriage has been dead for years,crap husband and father,can he sell the house if I don't want to?

Are the mortgage and deeds in joint names? If so I think you both need to agree it a sale, can you buy him out?

If you get divorced there are certain conventions that have to be upheld. Suggest you get legal advice.

Any property held in joint names should ideally be sold with the agreement of both parties but. In cases where an agreement cannot be reached there are legal ways to force a sale. There's a lot more to it than that, however, especially in the context of a divorcing couple. Other things have to be taken into account in the interests of a fair financial settlement. Ultimately all parties have to go away with a reasonable standard of living. That's why you need a solicitor.

You need to see a solicitor. A sale can be forced if one party refuses to sell. If you have encountered DV then you may be entitled to legal aid. DV is not just physical violence. Make an appointment first thing Tuesday to get a free consultation with a solicitor. Get paperwork together this weekend.
