Anyone know about divorce papers? Need help

Hello everyone,

I'm getting married in 8 weeks, but the court can't find a copy of my decree absolute and I'm scared my solicitor never filed for an absolute.

Does anyone know who I find out if a decree nisi was filed for, and if it was, how I find out the case number, so if I need to, I can file for an absolute.

We separated in 2001, had no contact since. I'm 99%sure the absolute was granted, but if it wasn't can anyone give me advice of how to get the info.

Thanks in advance. Jo x

Can you go back to your solicitor?

There is a way (DH had to find his going back 20 years) and he did. I'll ask him when he gets in.

What details did you give the court when you asked them to find it, and have they said they definitely can't find it?

Have you got any paperwork at all as that would have the case number on it.

You just go back to the court that granted it and order a copy. DH haad to do this before we got married. You couldn't actually get a marriage licence in the first place without presenting these documents, so did it not come up before?

Unless you lied of course

justkeepplodding · 16/01/2014 20:53

If you were issued a Decree Absolute it will just be a case of providing the Court with the case no answer paying a fee (used to be £5) for a for a copy.

If you don't have the case no you would have to ask the Court to do a search (used to be £40) and you would then get a copy. That's how it used to be when I worked in the family courts anyway.

Joanne279 · 16/01/2014 20:58

I need to provide it for my notice of marriage, at least 15 days before the wedding so NO PORTOFINO I DID NOT LIE!

Thank you others for your advice x

Were you the petitioner or the respondent?

PortofinoRevisited · 16/01/2014 21:03

Just contact the court and tell them the year of your divorce. They will find it.

Joanne279 · 16/01/2014 21:36

I was the petitioner x

Ok...you would have had to sign a piece of paper to request the Decree Absolute. Your solicitor should of then submitted to the Court 6 weeks and 1 day after the Decree Nicsi was pronounced. Any of that ring a bell lol? What info did you give to the Courts to try and find it and what did they say? PM me if you would prefer x
