occupation orders?

very very long story but in short- i believe my dh is alcoholic. he has been sober for 3 years and just started drinking again. we have 2 dcs and so i need him to leave, but he will not go. the mortgage is in joint names but i pay most of the household bills. I believe i need an occupation order? does anyone have any experience of this?

Sorry, that sounded a bit uncaring! Relationships is good for talking about the feelings and getting support and Legal is better for legal facts / situations HTH.

You would also need to get a solicitor's help. Speak to Women's Aid if you can.

If his name is on the mortgage, you are going to have to prove why he should not be at the house. So if he is violent, a risk to the children etc, abusive towards you......

i have just done the same, my dh was removed from the house by the police because he was a manipulative bully, i went to a solicitor the next day and he advised me of a non molestation order, thankfully never needed that but you are in your right to get one for lots of reasons.verbally abusive physically etc hope this helps.

thanks for that mouseface. Yes, I am ok, he is not violent. I feel pretty emotionally abused but I am well aware that it is not a dot on what a lot of women endure. He would never actively come looking to argue but is awful if I ever need to talk to him about ANYTHING particularly if I need to ask for his help-everything is my fault, I try to control him, I treat him like a dog-very much classic alcoholic, self-pity, takes no responsibility for anything; practically, financially or emotionally.
He is only dangerous in thta when he is drunk he has in the past tried to cook food and passed out and I have been woken up by the smoke (on a number of occassions) also often leaves the gas on. Its more the effect it will have on dd1 now she is a bit older, if she sees him in that state. Also I have a 4 month old baby to look after so really really dont need him battering on the door at 3/4/5/am because he cant find his keys.

Lenniesmom- sorry to here about what you have been through, hope things are more peaceful for you now. How quickly can they put the orders in place? I really really dont want the police at the house, but I am assuming that happened as you were being physically threatened? I have an appointment to see a solicitor on Tuesday
