Renting problem advice needed!

This will have to be quick as I'm using my phone to access the net.

I've just moved into a new property, today, hence the phone being used. Today has been a nightmare, from start to finish. We saw this property advertised and it ticked all the right boxes for up, one of these was GCH, we weren't looking at any properties without it. Upon realising there were no radiators we called the letting agent and were told it had underfloor heating. So fine we thought. And so a month ago we said we'd take the flat, the only thing we asked was that all furniture and items in cupboards were removed, they said fine.

So two days ago it starts snowing and we realise we are unlikely to get to the letting agents to pick up the keys in the weather, so asked to pick them up before the roads became ice. They said fine, come by Wed afternoon and they'd make sure the keys were cut. We assumed they just meant that they needed a spare set for the pair of us. No. They only had the master set and despite knowing we were moving in today hadn't got keys cut in advance.

So we take the master keys and today we head to the flat, where we discover that there is no heating at all. None. Aside from a gas fire in the lounge.

So my DP calls the letting agent to ask why we were given wrong information and whether we'd be able to get heating and to ask for a discount on rent. Now we are on benefits due to disability so obviously on housing allowance. The response my DP was to be called a "problematic DSS bastard" and told to return the keys or they'd call the police. (Btw we'd signed contracts and paid our deposits and first months rent).

Then when DP got to talk to someone else they arranged to buy us heaters and give us money off our rent.

Then it got worse again. There was a gas leak in the kitchen, then when the guy from the gas board came out he condemned our gas fire saying there are signs of carbon monoxide.

Then, in addition, we find we have no hot water.

So, to recap, we are in a flat with no heating in the middle of winter and no hot water. We have two heaters in a two bed flat, so are having to drag them round after us. The heaters are, as you can imagine, the cheapest they could find. We also now know that even if we wanted to stay beyond 6 months, they wont let us. So somehow we now have to find a new place, and, more importantly, find the money to move.

I have no idea what to do. All I know is that our heating now costs more than we bargained for and I'm so cold. I wish I could wake up and find today was just a bad dream.

Anyone know where we stand or what to do?

My former landlady knocked money off the rent when there was a problem with the boiler, but she was nice and we invited her to our wedding.

Citizens' Advice Bureau is a good call to make. Could DSS help? After all, they should not be paying rent to skiving laddlords!

have you contacted brighton housing trust?

the problem will be getting something done fast. You may well have a compensation claim, but that's not really an immediate solution to the problem, I know.

the other flats you viewed - are any of them still available? In your shoes I think I would demand the money back - deposit and first month's rent - provided you could quickly find somewhere else.

I dont know where to start on this (I am in property management so this is my thing).

It is illegal to rent out a property with no heating whatsoever.

This agent should be pursued. Do you still have the sales details? If so you can report them to Trading Standards and I would go to the local paper.

In fact go to the paper over how your husband was spoken to anyway.

I wouuld really like you to name this agent but I dont suppose you will, or MNHQ will allow it, which I can understand.

How can they threaten to call the police on you? On what grounds? You have rented the property and are legally entitled to live in. You are not fucking squatters.

Sorry but I am so angry on your behalf.

It would be so much easier to talk to you on the phone than do all this here, especially as you are using the net on your phone.

You have been given that property under false pretences and they must now sort it out for you.

Do you have a contract stating what the amenities are?

If they have promised certain facilities which are not actually there then you can take them to court and certainly should contact the housing people at the council who should let you know what your rights are and what private landlords should provide.

They have lied about the underfloor heating obvioulsy but was it in the contract?

Molly you are an angel!

Just an update, one of the cheap heaters has broken. The gas men have been over and weren't told to fix it. The immersion heater broke this morning, not sure if we had the valve leaking water all over the floor yesterday.

I'm currently sat here wearing tights, jeans, socks, slippers, two jumpers, my coat and gloves!

They never gave us anything in the contract saying what was included. Unfortunately they told us about the heating over the phone and I can't find a cached version of their advert.

I've emailed Brighton Housing Trust, some newspapers and watchdog.

Kaloki I'm so sorry, some landlords/agencies are just awful.

Take BigBadMummy's advice, she really knows what she's talking about - you do NOT have to accept this shit!

(I am currently in a legal battle with my ex-landlady and although it's costing me a lot of money it'll be worth it to see the smirk wiped off her face. )

Also got spare electric blanket, so do get in touch. What area is your new flat? We are in Kemptown. If you are anaywhere near the marina I can give you a blipper to get into the Marina showers (nice clean warm shower block). Can you tell we spent a very cold Manchester winter with a boiler which kept packing up and a landlord who couldn't be arsed to replace it? All sorts of kind people helped us out and I really believe what goes around comes around x

call shelter england they can give you some shit hot advice regarding landlords and and and - if you ask them they will send a letter on headed paper - and it usually shits the fuckers right up

call your mp

get everything in writing from now on

get the names of people you speak to and get the fuckers sacked

We'll be calling Shelter today and will email our MP, thankyou for that. We've arranged to see a solicitor on Monday as well. DP's mum has offered to pay for it. A friend has offered to look after our pet rats for a bit so that the cold can't hurt them.
Don't know if anyone knows much about electrics, we had both heaters plugged into a surge protected extension cable thingy and it switched off, when we felt the plug, both it and the socket were hot. Any ideas?

I wonder if it would be worth contacting your local paper, too. Two disabled people rented a flat which turns out to have no heating and no hot water sounds like a good story.

Hi Kaloki,

Did you see the revised email address above? Sorry I got that wrong first time, please can you forward anything you sent to the first one as otherwise I won't get it! You can't have 2 heaters on one extension cord, the cord will have a 13 amp rating and one heater will use almost all of that. They will get hot if too much current goes through, but they should be fine if you plug into two different sockets. I am glad someone has the rats - we have had pet rats and they were the best!

Already emailed them GrendelsMum, waiting on a response. We've now lost a second heater, due to what appears to be dodgy electrics. An electrician friend says it sounds like it's been wrongly wired.

And of course the letting agents are shut over the weekend.

All the electrics in the living room have gone and we have no emergency number for our letting agents. This is so far beyond a joke now I hate it here

Oh sweetie I am so sorry you are having such a crap day when this was supposed to be a big improvement on your old flat. Is there a fuse box in the house? Maybe one of the trip switches has flicked off because of the heater? If you can find the fuse box is one of the switches out of line with the rest?

We can't make heads nor tails of the fuse box, we called some electrician friends (unfortunately they all live over near London) and they had no idea.

We can't heat the flat.
We can't get away from the flat.

We can't afford an electrician. We can't reach the letting agents as they haven't given us an emergeny number. We can't get to a B&B. We can't get to the train station. We can't get through to Shelter. We don't know what to do.

So close to cracking up. My anti-depressants aren't touching this

Do you have electric in the bedroom? Can you get in there under a duvet with the TV/games console on. Just get through until Monday and then it will almost be to your advantage that the situation in the flat is so rubbish, they will HAVE to sort you out. Thinking of you - wish I could do more to help X Just remembered these people, Unemployed Families Centre (you don't have to have kids) they are LOVELY, cheap organic food, yoga clases or tai chi (for when your back is better), benefits advice and practical help. Do you have anywhere else to stay until Monday morning? This really seems entirely unsuitable.

If not, can you scrape together the money for a couple of nights in the local youth hostel or B&B?

The other thing I've thought of re the electrics - are there any neighbours in the flats who might have the same type of fuse box and who have already worked out how to use it?
