Neighbours fence issue

Hi all, my neighbours fence has broken in a storm about 4 months ago. It's hanging into my garden but hasn't fully come down yet.

I've spoken to the neighbour and they've said 'it'll be fixed' and I know they rent but they won't say when the work will be done or who their landlord is so I can chase it up.

I have a small child who now can't use their own garden in the nice weather because if it came down on top of them it could really hurt them.

My landlord obviously won't fix it since it's not his fence and I can't afford to fix a fence that's not mine either.

What do I do here?

Do You have a male friend or relative who once it gets dark could just pull it down and throw it back in their garden?

Environmental health might , at a push, write to them and ask for it to be removed or made safe
There is no requirement to have a boundary fence though so they can’t request that

To be honest that's all I care about really is that it's safe even if that means there's no fence.

I've checked land registry and it's definitely registered to a landlord but their name is not listed.

No not long moved to a new area so don't really know many people yet.

I suggest that the OP has done as much as they can

The difficulty is getting those she has contacted to take action which either it doesnt meet the criteria or they have decided not to

I emailed the council with no success and my estate agent has said they have also contacted the council to try and see if they get anywhere so I'm waiting to hear how they get on incase maybe they have a contact they use for things like this.

I’d phone letting agents in the area.
Perhaps it’s been on their books at some point

Technically their fence falling into your property is a trespass
I’d write a letter to the landlord and ask for the trespass to be removed. . Post it into the next door neighbours videoing yourself putting it through the letterbox. Mark it urgent on the envelope

give them two weeks to remove the trespass
If Nothing happens you can move it off your land

It is not your landlords responsibility to repair or replace the fence. If it isn't his it would be an interference to the neighbours property. If you want to put your own fence up that's down to you.

I suspect that the issue is a 'Health & Safety' one which the owners of both the OP's property & the adjoining one may be liable to deal with, at least by taking the fence away if nothing else
