I am purchasing a house from my parents. Only my dad is on the deed of the house, I believe legally he is the only homeowner as he is the only one on the deeds.

My parents are divorcing and it has been shared that my mum has stated that she does not agree that the "house is transferred into daughter's name".

Firstly, it will be a transfer via purchase. This is being done through solicitors, albeit a private sale.

Can she stop my dad from selling the house to me? It is being purchased for full market value, minus estate agent fees. I have just had a valuation done on the house, and once my mortgage is approved I have broker fees to pay!

The house is part of the marital pot so your dad has no business selling it while going through divorce proceedings. You both need legal advice but your mum is absolutely right to object.

Also what is your Dad’s plan for the proceeds of the sale because if it does go ahead, that money is also part of the marital pot. Is he trying to avoid giving your mum her share?

As others have said it is part of the marital pot even though only his name is on the deeds. Aside from that I’m not sure why a estate agent fees are being paid as surely there was no estate agent involved as your father is selling to you and presumably did not put the house on the open market

The offer I made was the value of the house minus the estate agent fees.

I am aware it is a marital asset, no one is trying to stop her from getting her share. She will be given half of it. She is just trying to stop me from purchasing it.

Do you actually want to purchase it? Will it not have negative connotations. Are you being sentimental. Is it really the best option for you financially and psychologically?

Until your parents have a divorce settlement signed and agreed your Dad can’t complete on the sale. It’s not his.

That's not true regarding the settlement according to the legal advice I sought. It can be sold prior to the divorce as long as it is sold at market value. It was all sorted, she agreed to 50% and purely does not want to sell it to me.

No sentimental value, I never lived in the property. I left home at 17. I keep her at arm's length as she is controlling, manipulative and abusive. She doesn't like me which is fine, I've accepted that. I just want to buy a house, which happens to be this one.

I would find something else suitable. If your mother is controlling and manipulative just dont feed her.
