Estate Agent - My vulnerable position

Hi, my estate agent coincidently owns the other flat on my floor. I ran into bother when I went to sell my flat two years ago. It turns out, I have no lease plan and to make matters worse, the other flat's lease plan shows it to be where mine is. (Yes I will be pursuing thus matter with the original conveyancing solicitors.)

It has been an absolute nightmare. I have required my estate agents full cooperation in seeking a deed of variation. While he has had to cooperate, he has not paid out any money. That's a separate long chapter in my nightmare!

This process is coming to
an end soon and we should be able to submit revised lease plans to land registry soon. With this in mind, I have approached estate agent to put flat back on market. He's said that's fine but he'll need to send out new agreement paperwork. I feel very strongly that he will up the commission percentage that we previously agreed because he knows he has me over a barrel. I won't go into why I think this but thete have been a few professionally grey areas in our dealings.
What can I do if this happens? Nothing until after I have my new lease plan and my flat sold right?

Change estate agent. He has a vested interest.

So if he shows someone around he doesn’t like or feels may be a problem for him he could put the sale into jeopardy?

This sounds too messy to continue and has room to cause you issues . Move estate agents to someone less involved .

why on earth are you using this person as an agent? Use any other realtor on the planet but this one. They sound as dodgy as fuck. Avoid and do not do business with them!!!

Thank you for your replies. I just imagine him backing out if I don’t use him. I feel really stuck!

I should say he doesn’t live in flat. It is an investment. I also didn’t know he owned it until the issue with plan was raised.

Can you not wait until the lease plan issue is sorted, then put it on the market with another agent? And if he says anything you can just say you felt there was a conflict of interest with him.
