Looking for some advice as am completely new to buying. Had an offer accepted on 6th June. I am a cash buyer. New property is currently empty as tenants have moved out. It is 3 doors down from the property I currently rent. Since then nothing has happened. I have instructed solicitors and provided all of the necessary information.

The last I heard was on 27th June when the estate agent let me know that the vendors have the initial paperwork to fill out but it may take some time.

Surely this should be the simplest transaction ever. Am I being impatient? Should I speak to EA or my solicitors?

My vendors took a few weeks to fill in the paperwork and get all the paper together. They were slower than past purchases I'd done. However when we got it , we got absolutely everything they needed to give us at the same time so they did it well.

I would expect to get something from them soon. If not I'd question their motivations to sell and be telling the estate agent that.

It sounds like.it's been a while since you last heard anything. I would chase up the EA this week.

Have you and/or your solicitor received the Memorandum of Sale from the EA? It will say:

Sellers:

That's the first important piece of paper.

The next thing that comes is the Draft Contract Pack from the seller's solicitors to yours, comprising of:

TA6
TA10

And maybe some other stuff mine included (I got the Title Plan at the same time - a big red area drawn around the house to check all the land is included)

The thing about TA6 and TA10 forms is that they often require a lot of backup paperwork to go along with them.

The seller can choose to supply all that later, or wait until they've found it all so they can put it all together to send to their solicitor all at once. Guidance from the Law Society on TA6:

The documents asked for may include: • service charge bill (up to the last three years) • New Build Warranty (for example, NHBC) • planning consents or similar for the property or any extension or conversion • solar panels: electricity feed-in tariffs (FIT) or smart export guarantees (SEG) • listed building or conservation area notices • tree preservation order • Japanese knotweed management plan • notices received or given under the Party Wall etc. Act 1996 • guarantees or warranties, for example, for damp or timber treatment or for the installation of glazed units or other works at the property • electrical work certificates and guarantees • central heating guarantees and warranties • agreements with neighbours about drains, pipes or wires or any other property matters • completion certificate for gas installation (Gas Safe certificate) • plan showing the location of the septic tank or small sewage treatment plant and how access is obtained • Green Deal financed energy performance installations • radon test report

So, if you haven't had the Memorandum of Sale and nobody has yet chased for it, nobody is doing their job properly.

Did your solicitor have you fill out a bunch of forms and give a load of ID and proof of funds yet? Did they ask for a few hundred quid upfront to start Local Searches?

If not, you're not actually signed up, and nobody has started anything at all yet. A solicitor will sit on it until they receive the Memorandum of Sale.

No worries. Just going through it myself at the moment (but I've been lurking on this board for 2 years, so I'm a right know-it-all/had a purchase fall through halfway through a few years ago so sort of remember).

'Dear DumbArseDog EA,

Can you please let me know when my solicitor can expect the Draft Contract Pack from your vendors. They will not order local searches until it is received.'

That should get them moving.

And, your solicitor almost certainly won't order Local Searches until it's received, because she'll send the TA6 and TA10 over to you, and if there's anything you find particularly objectionable in them, the purchase could fall through. It's their job not to waste your money, you see.

For example, in mine, I discovered that, despite what we discussed at viewings, the person I'm buying from wouldn't commit to ticking the box that that she's not going to form a chain or some such thing on one of those forms.

Guess what.... I'm now in a bloody chain.

(I sort of knew that would be a risk all along)

However, you CAN instruct your solicitor:

Dear PatientCat,

I understand we've yet to receive the Draft Contract Pack which I have now chased, but I'm still keen to proceed with ordering Searches straight away please. I understand that I will lose money you have spent on those searches if anything in the Draft Contract Pack turns out to be contrary to what was agreed with the seller and the purchase doesn't proceed, and am happy to forfeit those monies in order to expedite the process.

I sent that, and as soon as she had me check and SIGN the title deeds (red outline showing boundaries of property), she ordered them the same day.

Or, you can just wait, and not waste £200-300 - but - be warned - my searches are meant to only take about 14 days, but I've recently seen people moan on here about a 9 week wait for LS to come back recently.

Hurrah! I swear current bestie is GranddadDumbArseDog in disguise.

Put 'conveyancing flow chart' into google images.

I had two law firms send me extensive flow charts for the process as part of their 'sign us up, please' packs. They don't cover everything but they'll give you a good general idea.
