Building control charging us twice

We applied for local borough council building control prior to work starting and paid the full fee. The work is done now - it was knocking down a supporting wall between kitchen and dining room to make it open plan.

When our builders took the old kitchen floor tiles up the floor came away beneath (old 1930s semi) to such a degree there was no option but to dig it out fully and lay new concrete. They put a layer of insulation in as part of this.

Building control argue this was not listed in the original planned works and therefore are insisting we make a whole new application and pay a whole new fee even though it was inspected at the same time as the rest of the works.

Our architect has written to them to say this is unreasonable and I have spoken to them on the phone today but they’re not budging - basically they laughed and said that’s just the rules.

They have said I won’t get anywhere if I try to take this further and that if I want the completion certificate I’ll need to pay again. Just wondering if anyone has any advice / whether I do indeed just have to suck this up?

Similar thing happened to us. We just had to suck it up and pay as we really wanted the completion certificate sorted.

how much is the fee? Is it worth it in the grand scheme of the project just to get it signed off? Even if on principle its wrong, if its like £150 I’d just suck it up and forget it. For £1000 I’d be more inclined to argue!

If you don't have a completion for the original works yet i don't see why this doesn't come under an amendment to warrant?

This would be £150 if the additional work was less than £5000, not sure if councils vary though.

No the architect did not charge us to write the letter
