Did we need a party wall agreement ?

5 years ago we had a single storey kitchen extension approved, all done, signed off by building control etc.

We’re now selling our house and it’s currently going through searches with buyers solicitors. I’ve just thought we never had a party wall agreement with the neighbour on the left side, I did go round and ask them to sign one but she said no you don’t need one I’m fine with the extension and that was that basically.
Now I’m wondering is this going to come up in the searches and enquiries?
The extension is within 3 meters of their wall. We’re mid terrace. There is about id say a 1/2 a metre gap between our wall and theirs.
Really hoping it isn’t going to be a problem as don’t need more shit to deal with right now !

I amm not a party wall surveyor but I thought a party wall was a shared wall between neighbours so if you are terraced then I presume your other living room walls are shared. If this wall is built entirely within your boundary with a gap. I don't think it would have needed a party wall agreement.

BUT - as I say - not a surveyor. Hopefully some who knows better will come along . I do think you are wise though to address this now rather than after offer , searches etc. Not sure who to phone to get a definitive answer but if you are worried you could perhaps find out and ring - that's what I'd do. . 💐

Hi thanks for replying. The only walls shared are the original kitchen and front of the house, the extension used to be a conservatory and that was obviously separate to next doors living room wall. So basically the wall was never attached to one of our walls if I’m making sense ? I may need to do a diagram lol

It doesn't need to be a shared wall to require a PWA. It depends on foundations etc.

However, I'm not sure you can have a retrospective one even if was required in the first place. The whole point is to allow neighbours and their property protection during the construction process.

Ahhh, I thought we would be able to get one still.

As I say I did try, she wasn’t interested at all.
If it turns out one was required where would we stand ? Considering we did try.

We didn't get a Party Wall Agreement when we did an extension, although we realised later that we should have done. It wasn't queried when we sold the house. As a previous poster said, you can't do them retrospectively and they wouldn't be any use even if you could, so not much you can do about it now.

This is good to know !! As I say everything else was done, even a building over agreement which we didn’t need and I was refunded by the county council for it.
I try to be organised but this one thing was niggling me !
