Indemnity Insurance

Hi everyone,
I am in the process of selling my house, and the buyers solicitor have been going back and forth with our solicitors for weeks over an enquiry about right if acces for a driveway. So we have a deed of easement that allows us to cross iver the oublic footpath, there is then a long strip and then out r house. They are querying the right of access over thay strip. As its a an ex local authority property, the local housing association was involved when we purchased thehouse, and our solicitor confirmed that we have right of access all the way to the property due to adopted highway. However the buyers solicitors are not satisfied with this and have said this is incorrect. I emailed the housing association and asked them for confirmation that we have right of access iver the questioned area, and they sent me the deed of easement which we have already sent to the buyers solicitors and they are not satisfied with it as they have said the local authority searches do not show right of way. Now my solicitor has suggested we purchase an indemnity insurance. I am happy to do this however is it common for this insurance to resolve this issue. Does anyone have a similar experience where purchasing this insurance satisfoes the enquiry?

If the buyers want an indemnity policy, just say yes. That will resolve the issue as far as you’re concerned and the sale can proceed.
