Tenant has no where to go. How do we move firward

We are selling our rental and gave the tenant notice in November. She has a social worker and recieves benefits. The council have said they won’t find her somewhere unless we go to court to evict her. She is willing to move but just simply can’t find any where. Do we need to through court? It just seems so brutal and uncalled for.

In normal circumstances that would be possible, but there are very few landlords now looking to buy. Lots of new rules, regulations and legislation to discourage them. The Rental Reform is the big one but the taking away of the ability to deduct rent from benefits is another. As well as the need to make major improvements before 2030 if the property is one of the 60% of private rental properties in the UK that does not meet EPC level C.

Two different things entirely, but both acting as deterrents to investing in rental property.

Direct payments is affected by a recent court case followed by Government confirmation.

If you want to help her you should follow the correct process @1744sunset as this is the only way she will be housed by the council. If the council considers her to be intentionally homeless they have no duty to help her.

And it's normally the tenant liable for payment of any fees.

It is the councils that are at fault here. If they would accept LL's notice and find the tenant somewhere to live, then it would solve a lot of evictions.

The current situation leaves tenants with no choice but to stay until they are evicted or they will be homeless as the council won't help if they go before.

You will have to go down the route of the baliffs if the council won't help you.

As PP said, the only alternative to baliffs, is letting her stay there for as long as she wants, which isn't an option if you want to sell.

It's a process and you need to take the emotion out of it. You might like her and she might like you, but neither of you can get what you need unless she is evicted.

Renting is a nightmare in the UK, beats me why anyone wants to do it these days. But, this is NOT your problem.
