Our sellers solictiors have mentioned they have paid iht to hmrc and they are waiting for hmrc code to apply for probate

Please could you let me know how long does it take to get hmrc code to apply for probate

Our code took four weeks to arrive.

Then probate took nine days.
so total of less than six weeks.

HMRC advise it will take 20-25 working days from receipt of the inheritance tax return and tax payment to issue the code. Sometimes they're a bit quicker, sometimes not.

On government website HMRC processing is taking 16 weeks at the moment.

My friend received the HMRC code 3 weeks after submitting the application, put in the probate application just before Christmas (2024) and has received probate earlier this week. So around 9 weeks in total.

The code took less than 4 weeks. Applied for probate the day we received it (Christmas Eve) and the grants of probate arrived towards the end of the 1st week of Jan. Ours was a really complicated estate too.

Good news! Here is an extract from a press release published 14 February 2025 from HMCTS:
The data published yesterday shows that HMCTS has slashed average wait times in December 2024 to just over four weeks. This compares to twelve weeks at the end of 2023 and over eight weeks at the end of June 2024. The improvement is a result of decisive Government action to reduce the backlog of cases which built up because of the Covid-19 pandemic.
Around 80 per cent of grant applications are now completed online, with digital applications taking on average just over two weeks to complete - improving support for those who need it and easing the burden on people who are navigating what is often a challenging time. For those who complete the application online and submit their documents without any issues probate is granted in less than a week on average.

that is a matter for the seller to deal with, it has no impact on your ability to buy the house once the probate clearance has been given

HMRC codes usually take four weeks or less. The probate office (next step) used to take ages, but I did two probate applications last year, and they took 2-4 weeks, so I can confirm that the news story linked above seems accurate.

Recently our seller got the probate within a week so that was very quick

Amazing! I've heard a similar story in the last week of a non IHT coming through within 2 days. We are still waiting for our seller's to come through, code was on it's way 3 weeks ago so providing the solicitor got the application in soon after that, we shouldn't have too long to wait🙏...although there was IHT with this one so...we continue live life in 'limbo'!
