Scaffold damaged roof how to complain

I had an issue with two back upstairs windows, so I asked a bricky to fix them, this involved scaffolding as I have a large conservatory on the back. Before the bricky started I noticed that the scaffolding was resting on the apex of my conservatory, so I expressed my concern to the bricky, he passed my concerns on to the scaffolder who replied it will be fine as the supporting beam will take the weight. The bricky has now finished and I was washing down the conservatory last night and we now have a leak in the conservation at the apex point, running down the house wall; I think the weight of the scaffold has disturbed the lead flashing between the conservatory and the house. I also noted last night that the scaffold boards actually don't sit flush on the decorative fleur De lis, they push down on them as the fleur de lis sits higher than the scaffold board; so even if the support pole supports the scaffold poles, when people walk on the boards you hear a creaking and the boards push down on the fleur de lis. The bricky has contacted the scaffolder last night, but didn't get a reply, he's told me to have a word with them when them come to take scaffold down tomorrow. I don't even know the name of the company as the bricky just gave me an all-in quote.

What do I do now, I can't see how I have much recourse. I'll tell the scaffolder tomorrow, but once he's removed his scaffolding, I'm left with nothing, the bricky has paid him. Any help is appreciated thank you

The scaffolder has fobbed you off you don't need to be an expert to see the outcome of how that was set up.
Hopefully someone with experience with this can advise you.
Since your contract is with the builder can you go back to him?.

You don’t have a contract with the scaffolder. He wont deal with you. Your contract is with the bricklayer. You have to go back to him, point out that your contract is with him and he is responsible for anyone he hired. Ask for his insurance details as you need to claim for the damage and does he want to organise it and get quotes or will you.

You may have to just get started right away on small claims court. Get quotes for a repair, ask for the money then when he says no, send a letter before action.

Check whether you have free legal advice with your home insurance policy. I am NOT suggesting you make a claim on your buildings insurance. The legal advice clause is a completely separate thing. I used mine to claim compensation for an injury due to negligence on the part of a company.

That scaffolding has been put up really badly. Take more photos from outside and above if you can.

The bricky hired the scaffolders so he needs to deal with them. Do you have some sort of contract? It should cover damage - the brickie and the scaffolders should have insurance.

Thank you for all the replies. It's awkward with the Bricklayer as he kindly reduced his fee by £825 as it seems we purchased a 'money pit' house, where external walls have no lintels, the electrics were as old as the ark so you couldn't have the tumble dryer and washing machine on at the same time and the boiler couldn't handle more than 2 people needing showers! The roof has such bad condensation, it rains in my loft on dry days, so we've got to get that done too! We paid for a level 3 RICS survey prior to buying which didn't identify any of this! We have run out of money and now this conservatory leak, I'm at my wits end. Scaffolders are coming today to take down their scaffold, so I'll have a word, I'll take some more photos and see what they say and if they will remedy it. I hate confrontation and causing a fuss, but it's one thing after another at the moment, really don't know how much I can take. if I don't get satisfaction today, I think I'll contact My buildings insurance legal team and let them deal with it. My DS is not handling the noise and stress well either, my anxiety is not helping him, but I'm so worried. Many thanks again

The scaffolding should never have rested on the roof, thsts very lazy as its not even very high. I would've thought a brickie could easily refit the flashing and solve the leak so I would push for this as the outcome.
