Landlord inspection

I live in a rented flat on the 2nd floor of a building. I'm the only flat on my landing.
My neighbours below who recently have moved in have complained that I have to many visitors.

My landlord is doing an inspection tomorrow.

I lead an active social life and dating life.
I'm a male and I see both genders.

My contract doesn't state anything about visitors.

My visitors are respectful and don't cause a nuisance. I don't make loud noises and I only have visitors in the day time on average from lunch till about 8pm tops, Monday to Friday.

I have paid my whole year upfront.

I feel violated and my privacy is being intruded, they have a crying baby all day and night, they leave smelly rubbish on there landing and I have never complained.

Further more the tenant below has been standing outside my flat door interrogating people I have invited over. Asking who they are and why they are here.

I'm trying to not get angry, but I'm a good tenant and it's not my fault. I'm not staying there for free it's my home and as far as I'm concerned I can do what I want as long as I'm within the law.

Any advice in how I should deal with the inspection tomorrow ? I feel like I want to throw a tantrum

Buzzer is on silent. And I never have visitors over after 8pm.

My contract doesn't state any mandate on visitors. Infact I'm within my rights to have 100 people over daily.

It probably says something about not cause a nuisance tho, and your neighbour considers you are. If you're not, no worries, your landlord will shake your hand, say thank you and carry on.

It only states that I can not have anyone staying over for more than 3 weeks.

There is no clause for daytime short term visitors. Therefore no limit

Your neighbours are absolutely within their rights to report this level of visiting, they are entitled to, and most people would.

Your contract doesn’t have to state this and your landlord is completely right to be doing an inspection.

Your contract doesn’t have to specify a number of visitors, it’s about reasonableness.

Not having a specified number doesn’t mean limitless, can’t imagine anyone would believe that. It’s about being reasonable, which 8 people at the door per day is not.

Your tenancy agreement will also say something about not operating any business on the premises, or causing anti-social behaviour.

Who are all these people? Are they a different 8 every week? There's something you're not telling us here, OP!

@R4R1 but you need to be considerate of the neighbours too. Having the door going every few minutes must be very annoying.....you can see why people have complained.

Not convinced the average person has 40+ visitors during the working week and then no visitors on the weekend!

I mean, that’s a lot of friends/hookups buzzing in past your neighbours home every day. I’d get ticked off with that too. Bet they can hear every time the door opens/closes and as much as you have a right to privacy, they have a right to quiet enjoyment.

The Landlord is probably checking you haven’t made the flat multiple occupancy and subletting, with mattresses all over the place, as it has been reported that multiple men are coming and going.
If your place is reasonably neat and tidy and obviously just you living there full time, it will be all they are interested in, if they mention the neighbour complaining about visitors, just tell him the majority are Amazon, Yodel etc deliveries and some friends may call round but not usually after 8pm and you really can’t understand their complaint.

I get why it may annoy your neighbours if they’re sleep deprived from having a baby and are sensitive to noise that may disturb a sleeping baby. However, if they were out at work all day they wouldn’t know who was coming and going, so I don’t see how it’s any of their business! It’s not like you’re partying all night.

What really ticked me off is that they crossed a line when he planted himself outside my flat door and interrogating whoever came and went.

If it was just the complaint and inspection alone i wouldn't be so upset.

They had claimed it's a security risk, so if you're scared why would you stand outside my door and question visitors.

Mostly PlayStation. FIFA and call of duty tournaments.

Sometimes my clients are over to bring payment and discuss progress.
Sometimes family.

So you ARE operating elements of a business from your flat? What does your tenancy agreement say about that?
The reason that could be a problem is that most landlord insurance for a property doesn’t cover use of a residential property for business operations.

They'll want to check you haven't actually got multiple people living there, and you're not using it as a drug den.

It sounds like you are treating the place as a business premises as well as where you reside.
Not surprised your neighbours have complained. Many wouldn't but many would, that's just the way it is.
Presumably all these people who call round use the same entrance as your neighbours and go pass their front door?
Feels an invasion of privacy when you expect to be living in a small block/building of flats that is very quiet during the day.
You can hear/smell their baby, presumably they can hear/smell all your visitors?

Whether your business was is legal or not, very likely your tenancy doesn't allow you to run a business from home, I think the building would need a change of planning for that. Regardless if you vacuum the stairs to make it presentable for your guests or not.

How did it go OP - as long as no nuisance behaviour/noise/ dog barking/the property being used as a cannabis farm then I see no issue.

If the landlord becomes shitty, tell them that you want the remainder of the rent paid back to you for the months that you haven’t lived there and you will leave and move elsewhere.

Just another nosey snotty neighbour who hasn’t got many friends clearly….. or an active social life!!

Update:

The landlords/managing agent, were actually more reasonable than I had imagined.

There texts seem pretty abrasive but she said it was on purpose to ensure a prompt reply from myself.

I told them that yes I do have traffic but I wouldn't call it excessive as it's between lunch time and 7pm. And weekdays only.

I told her, when asked about what am I doing, I said no offense but it's not anyone's business, however I'm a business owner, there's no guns or drugs or a weed factory as you can see.

I told her I do take clients here, friends and sometimes daily, that's the reason I'm able to pay annually and live comfortably.

I also showed her all the repairs I done to the flat, she was pleased. Repairs which should have been done before moving in.

I told her that the neighbour has been harassing me, violating my privacy by standing outside my flat door on my landing with another man and interrogating guests. She said that that's wrong and she had told them to not get involved.

She said we haven't had any noise complaints or anything, the only complaint is people coming in.

I told her I wouldn't invite people that pose a risk because then it poses a risk to myself as I sleep there and live there.

As a compromise I said I'm happy to swap flats but I will not change my lifestyle and if you don't want me as a tenant I'll happily leave.

She then said that the neighbours are leaving in about 2 months, so I then said, let me take there flat so my traffic doesn't bother any future neighbours and they were happy with this

They then went to speak to the neighbours downstairs, when they left, the neighbour went nuts and was in and out of the building multiple
Times and just lingering at the door and in the hall way.

Then a couple hours later he installed a cctv outside his landing on the communal stairs.

Now this prompted me to write my first ever complaint in my life. I feel like they are spying on me and violating my privacy and data protection. The neighbour have installed this camera with no consent from other tenants or landlord.

I'm waiting for a reply from the MA/Landlord

Unfortunately if the OP is in breach of their tenancy agreement by running business activities there then it may not be that simple! A lot of clauses in tenancy agreements are there for good reason. The landlord’s mortgage or insurance company may stipulate it is to be used as a residential letting only.

The landlord was accepting of my work and didn't seem bothered that I work from home half of the day.

Infact she was very happy that the property is pristine and I'm fully paid up.

I don't think they want to lose me.

However we will see what happened next regarding the neighbour installing unlawful cctv
